1. About TimberGem

TimberGem is a furniture and home décor brand specializing in handcrafted wooden furniture, room dividers, carved furniture, doors, cabinets, beds, wall décor and custom-made interior pieces.

Many of our products are individually handcrafted and may be made to order according to the customer's selected dimensions, finish, material, configuration or design.

2. Product Information

We make every effort to ensure that product descriptions, dimensions, photographs, finishes and prices displayed on our website are accurate.

Because our products are handmade, minor variations in wood grain, knots, color, carving, texture, finish and fabric may occur. These natural variations are not considered defects.

Colors displayed on screens may also vary slightly depending on the customer's device and display settings.

Where a product is shown in a particular finish or configuration, please review the product description and selected options carefully before purchasing.

3. Custom and Made-to-Order Products

Custom orders may include customized:

• Dimensions
• Wood species
• Finishes
• Colors
• Fabric
• Number of panels
• Carving designs
• Hardware
• Construction details
• Other specifications agreed between TimberGem and the customer

Once production has started, custom or made-to-order orders generally cannot be cancelled because materials and labor may have been committed specifically to that order.

Customers are responsible for reviewing and confirming their specifications before production begins.

For significant custom projects, TimberGem may provide drawings, photographs, measurements or other specifications for customer confirmation before production.

4. Prices and Payments

All prices displayed on the website are in the currency shown at checkout unless otherwise stated.

Prices may change without prior notice, but changes will not affect an order that has already been accepted and paid for.

Payment must be successfully received before production begins unless different payment terms have been agreed with the customer in writing.

For custom orders, the final price may depend on the specifications, dimensions, materials, finishing requirements, packaging and shipping destination.

5. Production Times

Production times shown on product pages are estimates.

Because our products are handmade, production may occasionally take longer than the estimated timeframe due to material availability, customization, quality-control requirements, shipping preparation or other circumstances beyond our reasonable control.

If there is a significant delay, we will communicate the updated estimated timeline to the customer.

6. Shipping and Delivery

We ship internationally using available shipping and freight services, which may include express courier, air freight or sea freight depending on the product and destination.

Estimated transit times are not guaranteed delivery dates.

Once an order has been dispatched, the customer may receive tracking information where tracking is available.

Customers are responsible for providing an accurate and complete delivery address, telephone number and other information required by the carrier.

Additional costs caused by an incorrect or incomplete delivery address may be the customer's responsibility.

7. Customs, Duties and Taxes

International orders may be subject to customs duties, import taxes, VAT, brokerage charges, handling fees or other charges imposed by the destination country.

Unless explicitly stated otherwise on the product page or order confirmation, these charges are not included in the product price or shipping price.

The customer is responsible for applicable import charges and for complying with the laws and customs requirements of the destination country.

Shopify notes that international merchants need to clearly communicate applicable delivery timelines and potential customs/import charges to customers.

8. Delivery Inspection

Customers should inspect their package and product promptly after delivery.

If the product arrives damaged, customers should contact TimberGem as soon as possible and provide photographs of:

• The outer packaging
• Shipping labels
• Any visible damage to the packaging
• The product and damaged areas

Customers should retain the original packaging until the matter has been resolved.

9. Returns and Refunds

Returns and refunds are governed by our separate Return & Refund Policy.

For approved change-of-mind returns, the customer may be responsible for return shipping costs and other applicable return expenses.

Custom, personalized and made-to-order products may have different return conditions.

Nothing in these Terms of Service or our Return & Refund Policy is intended to exclude or restrict any consumer rights that cannot legally be excluded or restricted under applicable law.

10. Product Care

Customers are responsible for following any care and maintenance instructions supplied with their product.

Wood is a natural material and may respond to changes in temperature, humidity, sunlight and environmental conditions.

Products intended for indoor use should not be used outdoors unless TimberGem has specifically confirmed that the product is suitable for outdoor use.

11. Website Content

All photographs, product descriptions, graphics, logos, text, designs and other content appearing on the TimberGem website are owned by or licensed to TimberGem/Sahel Enterprises unless otherwise stated.

You may not copy, reproduce, modify, distribute, sell or commercially use our content without written permission.

12. Intellectual Property

The TimberGem name, logo, branding, product photography, original designs and website content may be protected by applicable intellectual-property laws.

Unauthorized use, reproduction or commercial exploitation is prohibited.

13. Customer-Supplied Designs and References

Customers may provide photographs, drawings, measurements, sketches or other references for custom projects.

The customer represents that they have the necessary rights or permission to provide materials that they ask TimberGem to reproduce or modify.

TimberGem may decline a custom request where we reasonably believe it would infringe another party's intellectual-property rights or violate applicable law.

14. Accuracy of Customer Information

Customers are responsible for providing accurate information required to manufacture and deliver their order.

This includes:

• Name
• Delivery address
• ZIP/postal code
• Telephone number
• Email address
• Product dimensions
• Mattress dimensions where applicable
• Finish selection
• Customization instructions

TimberGem is not responsible for additional costs resulting from incorrect customer-provided information.

15. Third-Party Services

Our website may use third-party services including payment processors, shipping providers, analytics services, advertising platforms and other Shopify services.

Those services may have their own terms and policies.

16. Limitation of Liability

To the extent permitted by applicable law, TimberGem shall not be responsible for indirect, incidental, special or consequential losses arising from the purchase or use of our products.

Nothing in these Terms limits liability or consumer remedies that cannot legally be limited under applicable law.

17. Events Beyond Our Control

TimberGem shall not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, transportation interruptions, customs delays, government restrictions, strikes, carrier disruptions, international shipping disruptions or other similar events.

Where reasonably possible, we will communicate significant delays to affected customers.

18. Right to Refuse or Cancel an Order

TimberGem reserves the right to refuse or cancel an order where:

• Product information or pricing was displayed incorrectly due to an obvious error
• The requested product cannot reasonably be manufactured
• The requested customization cannot be safely or technically produced
• There is suspected fraudulent activity
• The delivery destination cannot reasonably be served
• The order would violate applicable law or third-party rights

If TimberGem cancels an order and payment has already been received, the applicable amount will be refunded to the customer, subject to applicable law.

19. Changes to These Terms

TimberGem may update these Terms of Service from time to time.

The latest version will be published on this website with the applicable update date.
